Can I have one licence per establishment?

The home office have advised that the probability will be to issue one licence with several addresses.

Who will be responsible for the new legislation within the organisation?

The organisation will be required to appoint a responsible officer for trade in scheduled substances. They must ensure that operations take place in compliance with the legal powers of the act. They shall be empowered to represent the operator and to take decisions necessary to perform these tasks.

Can we nominate anybody to be our responsible officer?

Your responsible officer must have confirmation that they do not have a criminal record. A comprehensive knowledge of precursor legislation, and the ability to use this knowledge to ensure your compliance.

How long will it take to obtain a licence?

An initial application for a licence must have a decision within 60 days of the receipt of application. Renewal of applications must be within 30 days.

What conditions are there when applying for a licence?

When applying for your licence you will be required to name your responsible officer, their position and their tasks. You must describe the places of storage, production, manufacture, processing and handling of precursor chemicals. You will be required to show that adequate measures have been taken to ensure against unauthorised removal from your site of precursor chemicals. You need to give a description of the type of operations carried out, the name and CAS number of substances used and held, and a letter of good conduct of the responsible officer.

Can our licence be suspended?

Yes, if the responsible officer changes and the replacement cannot prove proper conduct, or if the Competent Authority consider that your site security is inadequate.

Will our site be inspected?

Yes it is possible that your site will require an inspection by a Home Office inspector prior to the issue of your licence.

We have spin off companies on our campus, are they included on our licence?

If these companies are separate entities they will require separate licences.

Are there any reporting requirements?

You will be required to report twice yearly 31st January and 31st June on category 1 and 2 precursor chemicals

How do we know if we need to be licenced for category 2 precursors?

If your organisationuses over the threshold listed below per annum for category 2 precursers, you will need to register with the home office.

  • Potassium Permanganate   100kg
  • Acetic Anhydride   100 litres
  • Phenylacetic Acid   1kg
  • Anthranilic Acid   1kg
  • Piperidine   500g

Will we be charged for licences or registration?

Both licencing and registration will be free.
